REMEMBER one thing--It was YOU who stated you were smart according to that group (Mensa?) that has so much spam. There you go again grabbing at straws that you assume may sway others. The first person you listed, do you really think he/she only was a graduate of Mensa if there was such a thing back then.
The last one--is he/she a member that graduated from Mensa. Buy the way; what university did you receive your Masters and Doctor degrees from since you are so smart. Why not answer Mark's question since it is multiple choice, it should be a very easy question to answer--2 choices only should be easy for those not as smart as a rock so what is it 1 or 2?. I NEVER claimed to be smart but did graduate from university and college so the bit about Mensa and intelligence does apply to me as I never attended a single meeting (1) or (2) which is it?

  2.
Manuel,
SIMPLY do a search is mensa tests a scam
and watch the pages come up. What I find interesting is a person only has to be 14 to take the test.
Does this mean that you have the education of a 14 year old or were they smarter than you on the so called test-- Is this the reason you have such a hard time trying to get others to feel sorry for you?
You will definately never hear me say I am sorry to you.

  3.
Kevin,
As per your statement "Just for the sake of discussion, could a bottle be made fancy enough to mimic a copyrighted image be used in an infringing way?"
Your sole reason for doing this is to attempt to make fine art prints from another,s work and very likely SELL them for financial gain. I see no difference in this than printing $100.oo bills and wanting to sell them--likely a lot more profit involved UNTILL you get caught and your room and board will be paid by the government for a very long time. Ever hear of Criminal counterfeiting http://en.wikibooks.org/wiki/US_Trademark_Law http://www.marques.org/class46/default.asp?D_A=20100304
Designs of a piece of glass ARE Protected for example Coke. Vox paid someone to design the bottle then paid others for the ® and © then paid to advertise the product then you come along and want it for free minus the Vodka. There is a word that describes one when they take from others and don't pay--wonder what that word is? It is also against the law. Aspect of Packaging or Shape http://archive.agda.com.au/dm/projects/TradeMarkLaw.html

  4.
Kevin
< The bottle is clearly distinguishable to Vox even if I do not show the logo or any text for that matter. Is this legal> There are © signs here as well as other signs so hiding what you know by the positioning of the bottle will only lead to problems. WHY not contact VOX and tell them the purpose of you wanting to take the pictures or do you allready know what their answer will be. As you can see, it is not made in USA so just maybe the assumed USA laws do not appy. Much better to be safe than sorry in my opinion. http://www.voxvodka.com/voxv2/(S(32u2pn552tkynu45zd4obrqc))/Default.aspx
There you go once again being totally incorrect with the racial bit--The lip flapping bit was a cartoon about a rooster who thought the world owed it a living. Are you that insecure to blame racial issues--just think if all the stores that support the banning suddenly closed in the world---there would be a drastic drop in the taxes these businesses had paid in taxes so in return the goverment would be forced to make drastic cuts as to what they pay out for social services which in turn HURTS some of the most vunerable people--is that what you want. Mexico, the northern part was an area that we went yearly for ten years before numerous murders of tourists four years ago and still continuing. Nobody is safe in my opinion. http://www.centredaily.com/2010/03/26/1878792/police-chief-decapitated-in-northern.html as they even kill the chief of police

  6.
Manual,
What is with you--reminds me of a cartoon where it had the saying something like this "I see your lips flapping boy but nothing is coming out." ?????????Sex preditors, Afgan issues has little if anything to do with the original message in my opion--What am I or others simply because we like to take trips on a Harley
It would have been so easy to do a follow up on this providing one knows how to do a search on a computer. You will also see why the person can't go on taking pictures there.
http://www.nycphotorights.com/ see the section on Burlington Vermont forces photographer to quit his hobby>>>> there is no appeals process.

  7.
My opinions only and maybe not correct;
People like the one wanting me to feel sorry for him because he assummes his rights were violatede is quite possibly the joke of 2010. He sneaks up to get a shot without asking permission then publishes the shots without permission and brags about getting shots as people tell him that he can't take their picture while on PRIVATE property--nobody that operates a business there likely ever wants to see him again. Wonder what his comment would be if he sneaks into a privately owned place that happens to be a house and quickly moves his arm holding the camera with a longer lens on it--will he and others that assume Private Properly is theirs to enter and do as the wish---Try it in TX or Detroit where the property owner has legal permits to carry a 10 Mil Glock or a S&W 44 Mag and these are not racial predjuce in the least. Do the crime--live or die because of your actions

  8.
Ed,
As per your statement: "For the group shot, I'm hoping to use a tripod from up high-- it's been described to me that there's a large deck, then there's an even larger one far below, and so I'm hoping to gain a good vantage point." Having shot many larger groups, I do know that your hopeful high up shooting point can be bloody dangerous simplydo to distortion and getting far too much detail on the top of the head which in turn will cause dark areas in the eye socket area. It can also make some people appear as though they are leaning forward and others leaning backwards people. The other issue is noise if you have to use hight than 400 ASA and lack of pixels on the large print---sure you can boost the file size in most editing programs but all that does is add pixels that never were recorded so find out what is the maximum print size they will require then see if your present camera is capable of making that print. Most labs require 300 dpi for printinting reguardless of print size. Some will print at 240 if they can't have the 300. I would also suggest that you go to the place and try a few shots and see what you will have to do to get the shot and get away from distortion.
What does "Money is not a concern as this person is wealthy and wants to have someone that will "go around and take pictures". " You appear to assume( a very dangerous word or action) that this person's wealth means he will throw money to the wind and accept and pay for your work beit good or bad.
No where have I seen where the size of a print rquired is stated. That alone can be a desiding fact on what camera to buy The group shot is the #1 shot they want. What experiance have you at posing a group of 150 people? You can have $250,000.oo worth of equipment available to use but if you can't pose the people properly, the picture is not what he/she was after--same goes for light balancing and metering. The front row may turn out perfect but light fall off ratio related to DOF and lens setting will cause the rest of the rows to become darker and under exposed as the distance between subject and camera flash increase. One other item to consider is "Do you have proper insurance to cover a reshoot by a professional photogrher of his choice if your work is not up to his expectations or what another photographer would be capable of if he/she decides to go to court. Congratulations but KYAC.
Hindsight????
When the judge asks to see the samples and she shows samples similar to what Richard got????
Did the signed contract stipulate Canon equipment or was it hearsay. The issue of what can 100% be proved to a judge that what was was actually paid to the photographer may help a judge determine liability and who gets paid as it is very easy to find starting rates for pro's in that area. The Judge will likely not even take into condideration what Richard's friends would have charged him nor should they in my opinion--lots of reasons why people get friends to work for them and expect huge discounts --been down that road once too often. Yes too many questions are unanswered in my opinion.
These are my opions only. Richard may be100% in the right though. It may take a court to decide but it is sad that it had to go this far.

As per original message (The weekend we picked is a particularly busy wedding weekend for local couples due to it's placement between the summer tourist season and the fall foliage tourist season. Because of this, we planned way ahead, booking the hall we wanted and a Pro DJ friend of mine. The only thing missing was our Pro Photographer.

Unfortunately, the two great photographers I would have chosen were booked for the weekend, (my first choice was in Alaska, my second choice had already booked), so my wife and I started looking for photographers)
The DJ was a friend, It was a well known fact that (Technically, her photos weren't perfect) as per your thoughts BEFORE you became upset. Also, as per your original message "After some discussion and meeting with a few other photographers, we decided to go with the one we felt the best about. We set up a second meeting to verify a few details and seal the deal.

Little happened until the month before the wedding when we went over the final details of the wedding day with our photographer, (over the phone), and went over how final payment would be made.
In this area as is the case in many other areas, a photographer is booked at least six months or longer prior to the wedding date--sometimes it is a year or longer. Had you did this, very likely you could have got a friend to shoot the event with their XYZ cameras. She gave you a CDs or DVD's of 800 shots and that was likely what you wanted but the shots were not perfect. MY question is "Was this so called poor photographer paid the same rate as an actual Professional Photographer would have charged you for the event and files. What did you pay for her photo services have been asked by many but there never has been an answer. All I see in the above is hear-say and you wanting perfection--nothing from the photographer.
At the start of this a few days I was inclined to blame the photographer but as time goes on and no attempt to say what she charged you forced me to look closer. A very quick check on rates in that area starting at $2000.00 to $4400.00. Quite often quality carries a price--weddings is not an area to skimp on. You did have choices! #1 being booking people required for the event well in advance. The above is my opion only.
12.
Take a good accounting course related to small business and see a lawyer to verify who owns what and who is liable for what if you and your friend go separate ways. Hoping that every thing goes the way you plan it but friends and relatives were one thing the banks told me to avoid if I wished to stay in business. This was when I asked for a line of credit strictly for the businessin the 90's. The studio that another friend has that you will be using--what do you do if something happens and it has to be sold?
Just some thoughts.

  13.
John,
The client wants Raw files--For us and we do a lot of it, the reason they want Raw files is that it is easy to prove if there was editing done to the capture image. This is very important to them in court cases. If they only want a hard file instead of the loose file or they want more than 8 bit,ask if any other file types such as tiff can be used.

  14.
Sarah,
You want to share rights with the professional? You may have to pay the bills!
I have never allowed it to happen and never will as long as I am paying the bills here.
I will gladly work for you only after you pay me for this place. Will you please pay my liability insurance for jobs I contract to do also IF you want our wedding clients. 2009, we shot 135 weddings and this coming year as of now we have 150 with down payments of at least $700.oo On the legal issue--if you shots were to beproved unsatisfactory to the couple--will your inurance pay 100% of the costs to do a complete reshoot, brig and accomodate those that were part of the wedding, the dinner and drinks, flowers etcetera? If the couple don't want you taking the pictures, will they also pay for another professional to shoot the event. Ours will but does not cover those that we sub contract to.
For four hours covrage, we were paying $200.00 in 2003 but dropped sub-contracting after a talk with our insurance company when we were renewing the policies.

  15.
Mike,
The questions that you asked--Ask 500 people for an answer and quite likey you will get 485 plus answers.
Lets assume you want to do weddings and you approach a wedding planner in hopes of getting more business
YOU approached the planner
She tells her friend about me, and I toss my ex-client a $25 referral for helping me out
YOU paid the pittance of $25.oo EX-client--why the EX instead of former?
Who will be the person that a client (Bride and Groom) paid to take these possibly poor quality pictures.
WHO do you think should be held accountable for poor quality work and who do you think the couple will sue?
Get all required information you require from a lawyer in your area that is a specialist in this type of legal issues.
Having backup equipment equal to or superior to what you use to shoot a wedding is manditory for me as is having somebody with the talent to yield the same results or better as I do. After quitting mechanics, I went heavy into photography and back to school for it--the one major thing I learned was the person I see in the mirror in the morning is the person responsible for all actions that take place in or out of the studio while working. If a person does screw uo--it was me that hired him / her--same goes for my choice of lab. Far too many blame others for their mistakes in my opinion.
Last time for this topic for me
I was not taking pictures of ANY store or person / people and ALL the above were holiday trips with my wife. You must have special powers to know if someone is a dealer as many police and civilians become deceased simply because they were in the wrong place at the wrong time PLUS all were upper class areas. It all happens in a matter of seconds--not minutes and that is why I never saw a thing nor did my wife untill the bodies lay bleeding and crying or had the stare of death that I witnessed far too often as we went out to an accident scene with a tow truck. Those are the people I feel sorry for--the person that bragged about having taken the pictures only to join the ranks of the deceased--I don't feel the least bit sorry for nor did I shed any tears
Jared----Morgues cast many different lighting effects---have you thought about taking phots there?

  17.
Bebo,
What place(s) #1 is a few of the better rated tourist resorts in Mexico followed by parts of Detroit and a larger city in Quebec Canada. I feel a heck of a lot safer in Cuba and really safe in Texas where we have our second home--been in the three places on the list and within feet of people as they breathed their last breath and two were left with major parts of their body missing simply for taking pictures through a window. did not see it happen but did hear the bang and sounds of breaking glass--did you know that blood falling on you feels like warm rain but is sticky and does not swipe off easily. These people doing the shooting cared less about human life than I care about a spider about to bite me--just don't interfere with there business of dealing in drugs according to the police as they questioned us. I saw nothing as was the case for over twenty people but the person that claimed to have pictures just prior to the shootings was executed before the trial.
No, this was not Bagdad

  18.
Sarah,
Price is dependant on the QUALITY of the print. What will you be using for a camera to get that size of a print or are you just going to add pixels that never were recorded by increasing print size through some editing program? That size of a print 4 by 6 feet--what do you do if they want an UNEDITED print at even a low resolution of 250 dpi (18000 by 12000) pixels or a file size of 618 meg which is far beyond what my phase 65 back for Hasselblad is capable of even in RAW. A file size of 889 meg is required for a print at 300 dpi. 300 dpi is what most labs in this area require reguardless of print size to achieve excellent photos. If all you are after is poster size and quality doesn't matter, you might lck out with a full frame DSLR in the 12 to 20 meg range. My intention is not to sell the print...but to sell the service. Selling the print would be double chocolate icing on the cake. Having a print of mine on display in a reputable high traffic museum where the image was taken is another big PLUS in my book. What you are capable of producing will be viewed and JUDGED by all those that stop to look---It is up to you how they will judge you by the work you display.
Also, ratio will have a major effect on the lens distortion as those isles appear to curve in even more.
These are my thoughts only--good luck,
How are you going to use the camera if it is in your intestines and you are no longer living? Matters not how much booze you think you will be drinking or drugs that some have snorted or injected etcetra that some says kills the pain--10 mil and 45 ACP bullets and knives do kill all pain when used by some person or people. Is it really worth the chance for a picture without asking permission for the thrill of waiting to find out if you hear the sound of a bullet or knife tearing your body apart? For me, it is not and that is just one of the reasons I ask permission first and also know when to exit the area PDQ.

  20.
Dejan,
If those buildings are public places, why not try be in one of them after the place of business is closed without the owner's permission as the polce respond to a silent alarm. Try telling that joke to to business owner and police about it being public property. I do know the difference between public and private property--Do You?

  21.
My Personal Opinion Only:
If these shots were taken without the victim knowing you did so and then posted on here, by the looks of some of the people you may have to bend over to bruh your teeth providing you still have a few left. Trying those shots in many cities will get you a few bullets or knives in your body in today's today free of charge--if you are lucky, you will only get sued for invassion of the person's privacy. i have too much to loose to risk taking these types of shots in Canada or the USA. I ask first and get a signed release for anything I sell or display just to be safe. It may be legal in some countries and if it is--I want that in writing, not verbal.

  22.
Seath,
One thing that I have not saw on this message is "Man/Woman has limitations as does your choice of eqipment one decides to use. They deserve respect."
For instance, the person that buys used equipment--One question for those that suggest buying used to start a business---Why did the origiginal owner get rid of it? Quite often it was because the camera or what ever was not upto his/her needs so they replaced it with one that was. It may have simply been that they thought the life span was nearing its end because they were in this as a full time business and shoot 150,000-250,000 shots per year and can not risk equipment failure. Another fact is that Nikon and Canon FULL frame handle noise issues at asa 1600 with ease unlike the non full frame. One thing I did learn in mechanics--buy cheap tools and you loose your skin and blood when a socket or wrench slips plus you end up with bolts that just became much more difficult to remove because as I lost skin, the bolt also lost metal and wound up withh rounded edges instead of flat so after a few losses of skin, I bought Snap-on and kept my skin and blood. Poor choice in camears seldon if ever has the effect that my choice of cheap wrenches had on me.
Cameras I presently use Nikon D700 and Phase 45 and 65 backs on Hasselblads and yes, I find them necessary.
Garry

  23.
In requards to my previous message about Mamiya.. At Churchill, the batteries are a major issue as is the reliable functioning of the winder. At -50F lots of digital cameras failed after an hour or even less but was not an issue with Hasselblads even after four hours.

The Super Wide series s very close to distortion free picture--great for interiors or exteriors or groups in limited space and is also excellent for landscapes. specs> http://www.bhphotovideo.com/FrameWork/Product_Resources/SourceBookProPhoto/Section01MediumFormat.pdf

  24.
Harry Joseph,
"I had about $800 with me which 10 years ago was allot of money for me. The camera was located in this antique photography store that has long since gone out of business. I plopped my $800 on the counter and the guy behind it hands me the "Back" of the 500CM. I asked him where is the rest of the camera ? He says that's it, that's all you can get with that type of money !
He then pointed me to a Mamiya 645 that came with a grip an 80mm f 2.8 lens, a 45mm lens, a strap and I still had money to left over to purchase a Gossen light meter and some film."
Did you even know the price of a Hasselblad system at tat period of time. I do know that I never have paid $800.00 for an A12 back in all the time I have owned Hasselblad and I still use them Did the ??? Antique store simply want to get rid of the Mamiyya 645 (You don't state the model) so did you actually get a REMOVABLE back that you can simply swith between color or black and white backs Only a few leaf shutter lenses to gain higher shutter speeds is another draw back and there is no Mamiya match for one of my favourite cameras --the Hassselblad Super Wide Series-yes I've owned Mamiya including their super series--you get what you pay for if lucky. Try phoographing Polar Bears at Churchill Manitoba where you can go in close and leave a camera on a triod for hours and fire remote as you see something you want a picture of-the Hasselblad does it with ease for up to 70 shots if you have the 70 mil back and any of their motorized cameras as far back as the EL model--Can Mamiya do it--saw lots try it but never did get the shots they were after plus they were limited to thirty shots http://www.churchill.ca/ a trip that can easily cost over $ 5,000.oo that I would never consider leaving for without Hasselblad--others have taken them to the moon. If all you require is Mamiya--that is your choice but for me your choice is not even an option I would consider. Man is limited by their choice of equipment and traing plus experiance. I don't want to experiance an angry Polar Bear or hope a picture will turn out but if that happens, I can not blame my equipment.
