Photos stolen by chibasports.com

If anyone shoots sports stuff and posts on Flickr(where I presume they were lifted...), you might want to check out chibasports.com. They used a couple of my photos and one could only assume the rest were stolen too. The best part is the way I first found out: These guys sent an email ad to the buyer at the bike shop I work at, with a photo of mine used as part of the ad. Anyway, the buyer recognized the photo, which had our shop team riders in it... It's a small world.

They may have come from my Photo.net gallery, or Flickr... no real way for me to know...
Aloha,

This photo was used in the ad...

Doesn't Flickr's terms of use allow them (Flickr) to sell your images as stock without notice or compensation?

I may be wrong on this, but I seem to remember a case a couple of years ago where a school kid in Austrailia took a photo of 2 friends making the peace sign and then he posted it on flickr - where Virgin wireless saw it and grabbed it.

Jeff -

Actually - there is not enough information given - I was correct and stand by the statement (at least the part about them being able to sell them) - what is not known here (because the OP didn't indicate) is whether or not he posted on Flickr with a Creative Commons License.

If he did post them there under that agreement - all bets are off.

Now, if he can prove that they were not creative commons licensed or that they were lifted from PNet.... that's a different issue.
Prav - Love it.

Steve: First thing I did was send them an invoice! They already used the photos.... they get a bill regardless!

David: I NEVER use CC licenses. I ALWAYS reserve all rights!

Thanks for the responses, I really just wanted to alert anyone else that might have been ripped off... and vent a bit:) I'm glad I have a couple lawyer friends!

David Haas,

You're not at all correct about Flickr selling your photos. Nor do you understand the different types of Creative Commons licenses. Nor do you fully understand the Virgin Mobil case that you referenced.

Please do some more research before making such silly claims.
