Poor Countries Model Release

Recommended Posts

hello, I just started to move my pictures and I find that my main subject kids

is gonna be impossible to sell. Those pictures are from places where those kids

are orphans or parents don't know to write or even don't know what is a model

release, is the law and I respected but those pictures are there to show the

situation of one part of the world that doesn't know about photography laws and

even they will be very happy to be on the pictures.

My folder kids, in case that I get any money for any of the pictures, will be

automatically deposit in our NGO account, so even I don't profit from those

pictures.

There is anything that I can't do, I hear that maybe I can show the pictures as

editorial or news.

I'm lost about that, can you help me, thanks

If the pictures are used editorially (e.g. news), you don't need a release.

An editor may ask for one simply on the grounds of "better safe than sorry", but if it's obviously a news context the lack of a release isn't going to be a problem. Just think of war photographers. Think anyone stops and asks everyone in the shot to sign a release?

Editorial use isn't limited to news. Use in books, newsletters, magazines etc are - unless in

ads - generally considered editorial in the United States. Making money or not has no bearing

on if a photo usage is editorial or commercial.

Check out Carolyn Wright's site at http://www.photoattorney.com/ Good info on many issues

related to photo usage on that site.
