alex_feldman1
I hope this hasn't been posted before, but anyway - an individual photographer represented himself in court and won a lawsuit against what appears to be an unusually slimy company that had stolen his image. It' not only a feel-good story, there might be some useful how-to information here as well. You can begin here: http://www.cgstock.com/essays/vilana And then search around for the court documents, If you want.
rob valine
It's nice to hear some good news for a change about the business of photography.
William Kahn
Yes, but it will be interesting to see if the damages are actually paid.
john_wire
I hope Gregerson recovers something from Vilana. Likely not. I'll bet Vilana is "merrily on his way" somewhere. Too bad. Gregerson may need an enforcer with a big "stick". Regards.
ellis_vener_photography
Morale wise and legally , this is a great precedent for ALL photographers.
qtluong
Given that the infringement couldn't be more willfull, and all the other wrongs that were made by the infringer, including faking a licensing contract and counter-suing the photographer for $1M, I think the $20,000 penalty is small. Could it be because the photographer didn't retain an attorney ?
john_h.1
I don't know if it will be worth it in the end as this effort required much time, effort and resources, especially if the help recieved was billed at market rates. I'm impressed in any event. I gather that the photographer is an articulate advocate for himself in court. Anyone believing in the future that he is another photographer to bully around will be a fool. I also enjoyed the summary provided for August 3, 2007 in the Chronology. Hilarious! mahonri_moriancumer
Why hasn't the FBI and US Attorney gotten involved in arresting and prosecuting this guy? If he did it to Disney, Donald Trump or the NFL they would be all over it.
aimpic
If you go for someone as in law suite, first you make sure they have something, that you can get it and block escape is needed. I first went for someone about about 18 years ago, and got my money+!
minneapolis
Hi, this is Chris Gregerson, the photographer in question. I was informed of this thread after I started one here:
http://www.photo.net/bboard/q-and-a-fetch-msg?msg_id=00OcdY

I did report Andrew Vilenchik to the US Attorney and FBI. They started a file. I also reported him to the Dept. of Commerce, who is investigating his mortgage originator's license.

It's implied on my website that he and his attorneys face a lawsuit for malicious prosecution based on having sued me with forged evidence. I will continue to post updates, the latest info is a page about Andrew Vilenchik's two new corporate identities:
Andrew Vilenchik, Community Finance Group, and Custom Properties, Inc.
