I want to create a photo and stats book on Nascar drivers of the past and present. in Sports Posted January 27, 2005 What else do I need to know about this subject? If I use a photo of a model car, do I need to get permission from the Nascar team, driver, owner? I have some friends that gave me free use of their photos and can sign a release that they agree to me using the photos for publication. what does the driver, team owner, model car manufacturers, sponsor, or surviving family members of passed away Nascar drivers have to negotiate with me concerning the printing of photos that show their cars? I also need to know what words that are trademarked, licensed, or whatever the case may be for example: Curtis Turner is a name of a former Nascar driver, that raced when there were less lawyer terms to deal with and hardly any sponsor or souvenir deals. On today's standards Any current driver with a sponsor, team, car design, etc has everything licensed from his name to his car and sponsor to his paint scheme on the car. bottom line: If I use a Nascar person's name, statistics that he earned by racing each season, and any of his car makes and paint schemes from past or present, and they do not authorize it, or endorse it, can it be done? What is the rule when I see a book in a store called "The Unauthorized History of Racing driver X" ?? I have read different copyright info and still do not have any concrete knowledge of what is allowed and what is liable for copyright infringement from a lawyer standpoint?<div></div>
