Paragraph Stating Artistic & Technical Waiver

I just ran across something on another website that I've seen many

times, but I'm curious as to how many of you actually incorporate it

into your contracts. I tend to see in mainly on wedding photography

sites. It's a paragraph about "photography being both an art and a

science". It's basically a "creativity" clause so that the customer

understands about the photographer's personal artistic input into the

photographs, so that they understand that the photos may not be

exactly what they envisioned. Do many of you use anything like this

in your non-wedding shoots.

A standard release should include a phrase about modification. Mine has this embedded in its "usage" clause:

use, re-use, publish, and re-publish photographic portraits or pictures of me or in which I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations,

A clause about "art and science" or "creativity" would be pointless since it doesn't carry any legal meaning.

You can also include another fairly standard phrase, which mine has:

I hereby waive any right that I may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied.
