I would say it is a red shouldered, although the ones we have a Ca are a lot darker. I think a portrait crop would work better here.

While walking around Loxahatchee in Florida I encountered a genuuine raptor aficionado (from Saskatchewan) who named this bird for me.

Very nice capture. I agree with Monte, a vertical crop would work good here. It could use a little more canvas at the top as well.
