As photographers we have the right to portray our images in any manner that we choose to express them. There are very few "perfect" images, (whatever those are), so what if the technicals are not "perfect", you like it, and others obviously do too. I personally think it is a great shot, nice tones, his face may not be expressive, but his eyes are. To me it comes across as defiant, yet can almost interpret a sense of mirth in his eyes.
