Are there any issues regarding privacy right protection in the USA? According to the Italian law, I could not upload a photo like this without the portrayed persons written consent (!!!!!) ... personally I have decided that I don't care.

I enquired about the existence of such laws sometime ago. It seems that in the US pretty much anyone can be photographed in/from a public place, and this being a market, is one such. However, if the person objects to the photographing process, that must be honored. There are photographers' rights varying from country to country... I suggest you get one for Italy, or just talk to a lawyer.
