john_aceti
I have a customer that has customized a motorcycle with a cartoon character theme. I am to photograph the bike and they will be writing an article and submitting the photos to a magazine. The logos on the bike were done without permission. Now I know if someone was doing this for their own use it probably would not be an issue but now that the bike will be featured in a magazine I need to know if I need (and pretty sure I do)to get permission by the Trademark owner in order to photograph this bike with those logos on it. This bike was a one time production done by the request of the owner. Please advise on whom I should contact for appropriate permission. The bike is called "Superman". jim_gifford
John, for editorial use in a magazine you do not need permission. The person who might need to get permission (hmmm, or at least forgiveness, as in "it's easier to beg forgiveness than to ask permission") is the artist who created the graphics on the bike. You, as the photographer, aren't violating copyright or trademark or service mark for a comic strip character. Be well,
