Yes, this is very interesting. It seems to me that posting a photo publicly on a site like Instagram should allow anyone to share that link. It sounds like Instagram's Terms of Use make that clear. Asserting that you posted a photo in such a public place but it can't be further shared by others is wanting to have your cake and eat it to (how's that for legal wisdom, a la King Solomon). I don't have Instagram account and am not a lawyer but I think the judge's position makes sense.

Seems to me its pretty well understood by now that when one posts a photo on a social media site, it's basically up for grabs. There was some recent discussion about this in a thread named "HELP I GOT SUED", (or something like that) but that was under a different set of circumstances, where somebody grabbed a photo owned by Getty Images and used it on their website. Getty, of course, came after them. We tend to just "agree" to site user agreements, because let's face it: who has time to read all that stuff? But lo & behold, often, we "agree" to give our stuff up- whether we know it or not.
