  1. <p>I see decided difference in quality between film and digital, film takes it for me, though there's been more discussions of that than grains of sand and having one is not my desire. But no matter what the opinion I think as the rush of the New wears off people who are attracted to photo quality have similar views, or at least see the possibilities film offers for the first time - and want to try it.</p> <p><br /> Anything new and quickly widespread will fade a bit after time in instant preoccupation, and in the relaxation from that other ways including "old" ways will be seen - and tried.</p> <p><br /> You can do both after all as has been said. They each have plusses and are different mediums. Should you have no footwear other than boots? Or only red underwear?</p>
  2. <p>People or buildings on private property adjoining public property do not enjoy any legal bar from a photographer taking photos who themselves is on public ground. If invisibility in that way is the goal no one forced you to build there or be there.<br /> EXCEPT on micro-photo sites, where any visible sign is off-limits, good luck with shots of Times Square. It's because they don't want problems leasing, one-time, your photos; that it's legal is beside the point for them. And of course you must have a release from any person recognizable in your shot, even in public.</p> <p><br /> Now courts have held that a photo of a trademark is not theft of trademark, it's a PHOTO, not stealing the actual Coca Cola trademark and putting it on your own cans of swamp-water. </p> <p><br /> In the same way, I think an artistic photo including a person, the photographer and the person shot both on public property, there is an expectation to begin with on the part of the subject being in public, i.e., that they are fair game for their image being included in a photo. And again the photographer in an art shot is not possessing the person themselves like they are locked inside the camera, the photographer owns the photo, and the person and photo are not the same reality.</p> <p><br /> Now, if a public shot of me appears in a magazine ad it's a different story. Then an image of me is being used by the photographer as a money-making instrument and paying me nothing for shooting me and using my image.</p> <p><br /> In Australia I don't know. Could be closely the same. It follows logic. The photo and what the photo is of are two distinct realities. As long as it is not a commercial exercise in money-making the photographer only lays right to his photo, not to people, trademarks or buildings adjoining or on the same public property the photographer is on. <br /> (By the way, Courts have held a photograph can be artistic and still make money.)</p>

I've bought and tried two subs for the mercury that didn't fit in the unit. i'll try some more, but see I don't agree with you or others that the Seller should know these older units take mercury batteries because mercury batteries are out of the lexicon of average Buyers. Same with CV joints in cars. I know what one is and that at a certain car age they can need replacing, possible. But for the average buyer that is not in the lexicon of car questions. If it was, the level of automotive research necessary to buy a car would be ridiculous. </p> <p>Buyer Beware is a good attitude, but as a legal necessity it is variable. So, what may be termed items a part of the sales unit expected to function properly or be present, if they are not otherwise brought up in the ad, carry the expectation of being present, and working, or being an auxiliary that will function when purchased with the unit: the expectation is that there is no problem.</p> <p>So if a CV Joint is all screwed up the Seller cannot claim: "You should have asked"</p> <p>If there is such a problem, the Seller should state it or the Buyer may not be bound by the sale.</p> <p>On the other hand, if the item sold is a used suit and the Ad stated sizes in S M L XL, if the Buyer gets a Small suit and it's still too large he has no complaint, inherent in buying a suit you can't try on, is that a size SMALL, may not describe your degree of "Smalllness". That's an inherent risk.</p> <p>It's the same principle as Safety in Occupations: when I was a Steelworker and working at the Blast Furnaces, I couldn't claim as a Safety Violation that it was "TOO HOT". It was "too hot" but that is an inherent risky condition of steelmaking. In the olden days the Blower of the Blast Furnace actually speared a clay-filled hole the size of large manhole cover with an oxygenated lance in the bottom side of the Furnace, about 15 stories high and filled with molten pig-iron. Guess what would happen next?</p> <p>BOOOOOOOOOOOOOOM! MOLTEN-PIG-IRON ERUPTION out the side of that furnace, just behind the running-away Blower. Now they have a remote controlled lance to pierce the clay. But You Better Be Way Outta There when that special horn/siren blows or you will be a crispy.</p> <p>For me and most, batteries in light-meters would be expected to be purchasable, as Heat Shields would be expected, as functioning CV joints expected in used cars. If they weren't, it should be stated or returns allowed. Anyway, that's me. </p>

Or for you as for that bat: You don't know what happened in that incident with the camera, what I got for my money, or why or WHO was responsible for my keeping it, (with $600 of my own in it). DO YOU JETSTAR? Next time pick someone besides me. Really do. Now as to the 2nd point: going around hunting for old things, why would anyone suppose something was odd about batteries, in an '80s classic car they were seeking to buy, or an '80s Light Meter? Other research yes, like how did older light meters function in terms of accuracy, well I know this and for that brand. Are the electrics long lasting? That one also. Is it beat to a pulp? No, not at all. Yes, I did those things. But mercury batteries if their existence ever known about, for me or true for average Buyers, will not be a question that pops up. Nor batteries a research area. Why should they be? Do you ask about the condition of transmission transfer bars in pre-2010 cars you're scoping to buy? Do You?

And that, case per case, would turn on majority Jury vote which likely would change case to case. So, just because a private sale often has no recourse in Law does not mean it never does.</p>

If I had sold it not knowing I'd take it back though. The Seller knows I tried and failed to find an alternative, including WeinCell. He may have sold it innocently but he's knowing now for 3 weeks. Anyway, he's he and I'm I so what'dya gonna do. I could do a Credit Card complaint, but it's a lot of trouble for $40 - but I may. And I bet sooner or later some sub for the mercury will appear for me.</p>
  14. <p>It was time. I took my mind to the Vet and had my beloved Ebay Section Put To Sleep.</p> <p>I'm not a Real Ebayer: I don't stay up nights searching used Grave Clothes or WWII Bombers. But I do buy some things there, and bought two cameras: A Rollei 6008i that began as a rip-off and ended with my<br /> Credit Card win of money-back, and oddly I kept the camera after I had it fixed. The other, my only Leica which I'm happy with but could have a possible problem, I'll know soon. (It also has a good chance of Not having one)<br> <br /> I bought a Honeywell/Pentax Spot Meter that had a mercury battery and the Seller would not accept a Return, meaning I have a good chance of never using it because I can't - I tried two subs but they don't fit. I did the Ebay-Complaint thing and lost. For an unusable item I think the Seller should accept a Return. It's like my selling a Car with square wheels, and beyond the knowledge of the average Buyer which devices have mercury batteries, and since they haven't practically-speaking existed since the'90s many won't know zip to begin with about Mercury batteries or what that term means.<br> <br /> So, I cancelled Ebay and perhaps am biting my own nose but I feel a Biblical pleasure in smoting the heathens at the Market-Place.</p>
